  1. Shareware License Agreement

  4. 1. PARTIES
  5.  
  6.         (a) This license is a contract between you
  7.              (the end user), and Interactive 
  8.              Multimedia Software Pty Ltd, as the 
  9.              author and 'distributor' of this software.
  10.  
  11.         (b) If you find any parts of this agreement
  12.              unacceptable, you must not use this 
  13.              software. By using this software you
  14.              are agreeing to the terms and conditions 
  15.              of this contract. If you have any queries 
  16.              regarding the use of this software
  17.              please contact us at the address below.
  18.  
  19.         (c) This license grants you the right to use 
  20.              the copy of this software for the 
  21.              creation of two free greeting cards for 
  22.              personal and non-profit / commercial 
  23.              use, if you have not already installed 
  24.              or created two free cards with a 
  25.              previous copy of FunE-Cards. Profit 
  26.              and commercial use requires a 
  27.              commercial license which can be sought 
  28.              from the author.

  30.              If you decide to continue using the 
  31.              software and wish to create more cards,
  32.              you must pay the registration fee of 
  33.              US$10 to the author. After this time 
  34.              you will receive by e-mail a license
  35.              number allowing you to create as many 
  36.              cards as you wish from this individual 
  37.              copy of the software for your personal 
  38.              and non-profit / commercial use.

  40. 2. COPYRIGHT
  41.  
  42.         (a) This software is copyright, by Interactive
  43.              Multimedia Software Pty Ltd. All 
  44.              documentation files are copyrighted.
  45.  
  46.         (b) You may make as many copies of the 
  47.              software as you wish.
  48.  
  49.         (c) You may make shareware versions of the 
  50.              software available over a network to be 
  51.              run on other computers. You are not 
  52.              allowed to run / execute registered versions 
  53.              over a network or on more than one computer
  54.              unless you have purchased a site license.

  57. 3. DISTRIBUTION
  58.  
  59.         (a) Please feel free to distribute the shareware
  60.              version of this software amongst your 
  61.              friends and co-workers etc. You may upload 
  62.              it to any FTP, BBS, CD, or on-line service as
  63.              you like.

  65.         (b) If you distribute, you must include all the
  66.              original files in this distribution, unmodified 
  67.              with the copyright notice and license in tact.

  69. 4. LIMITATIONS OF LIABILITY

  71.        (a) Interactive Multimedia Software Pty Ltd 
  72.             give no warranties, either expressed or 
  73.             implied that this software is fit for a 
  74.             particular purpose or will perform 
  75.             adequately at all times. This software is
  76.             licensed "as is", and so you (the user) are
  77.             assuming the full risk of using it. You 
  78.             (the user) and or commercial organisation(s)
  79.             using the software bears all risk as to the 
  80.             quality and performance of the software. 
  81.             Interactive Multimedia Software Pty Ltd will
  82.             not be liable for any special, incidental, 
  83.             consequential, direct, indirect or similar 
  84.             damages due to loss of data or any other 
  85.             reason, even if Interactive Multimedia 
  86.             Software Pty Ltd or an agent of Interactive 
  87.             Multimedia Software Pty Ltd has been 
  88.             advised of the possibility of such damages.
  89.  
  90.        (b) In any event, the authors liability in 
  91.             respect of this software is limited by 
  92.             section 68A of the Australian Trade Practices
  93.             Act, 1974, provided you the (the user) conform 
  94.             to the requirements of that section.
  95.  
  96.        (c) If section 68A does not apply, the authors 
  97.             liability shall be limited to AUD$10, or 
  98.             the cost of replacing the software, whichever 
  99.             is greater.

  101. 5. GOVERNING LAW
  102.  
  103.        (a) The law governing this contract shall be
  104.             that of the Australian Capital Territory, in 
  105.             the Commonwealth of Australia.
  106.  
  107. 6. MISCELANEOUS
  108.     
  109.       (a) If any part of this license is later deemed 
  110.            to be illegal or unenforceable, then the 
  111.            part shall be null and void to the extent of 
  112.            the illegality.
